Until the adoption of the delegated act on design for recycling, expected by 1 January 2028, manufacturers are to rely on the existing PPWD framework and the harmonised standard EN\u202f13430:2004 to demonstrate recyclability.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\"<i>Manufacturers do not need to perform the conformity assessment procedure in accordance with Article 38 and Annex VII of the PPWR for recyclability until the entry into force of the delegated act(s) under Article 6(4) PPWR\u201d.<\/i><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">PFAS restriction:<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">The Commission recommends a stepwise approach to PFAS testing, whereby Total Fluorine (TF) quantification represents step 1. If TF is below 50 mg\/kg, the sample could be considered compliant.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">Food-contact packaging placed on the market after 12 August 2026 must comply with the PFAS limits, and the placing on the market occurs when there is an offer or an agreement between parties regarding \u201cthe transfer of ownership, possession or any other property right\u201d, done \u201cfor payment or free of charge\u201d, once a manufacturing stage of the product is completed.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">The FAQ confirms that the regulation does not differentiate between PFAS that are intentionally added and PFAS that are unintentionally present. Both are subject to the same restriction requirements. It also states that there is currently no harmonised EU method for measuring PFAS in food contact packaging. The European Commission is working with Member States, industry representatives, and reference laboratories to establish a common testing protocol.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">Packaging restrictions \u2013 ANNEX V<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><i><span lang=\"EN-US\">\u201cTherefore, in the absence of a definition of \u2018single-use plastic packaging\u2019, it should be considered that composite packaging, including paper-based packaging containing 5% or more plastic, is covered by the packaging bans in Article 25 and Annex V, points 1\u2013 4 of this Regulation. Packaging containing not more than 5% of plastic is thus not covered by this ban.\u201d<\/span><\/i><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-GB\">FAQ (page 32) point 1 of Annex V bans for grouped packaging \u2013<\/span><i><span lang=\"EN-GB\">\u00a0<\/span><\/i><i><span lang=\"EN-US\">\u201cThe most common examples of such packaging are collation films and shrink wraps, grouping two or more stock keeping units (SKUs).\u201d<\/span><\/i><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><i><span lang=\"EN-US\">\u00a0<\/span><\/i><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">Relationship between PPWR &amp; SUPD:<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">PPWR prevails for packaging formats, materials, and uses listed in Annex\u202fV. In these cases, Member States must apply the PPWR and may not rely on Article\u202f4 of the SUPD for national measures.<br \/>\nPackaging not covered by Annex\u202fV restrictions remains subject to the SUPD if it qualifies as a single-use plastic product under Article\u202f3(2) of the SUPD.<br \/>\nIn such cases, Article 4 of the SUPD continues to apply, requiring Member States to adopt measures to reduce consumption of cups for beverages and rigid food containers used to contain food for immediate consumption.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">Please note that this section adds a note on the SUPD review: \u201c<i>Finally, in view of the evaluation of the SUPD due in 2027, the Commission will assess the need to review the Directive, including to ensure coherence and consistency with the PPWR, promote a Single Market for packaging, and secure a level playing field<\/i>.\u201d<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">ART 29 Reuse targets<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">The Guidance addresses the meaning of \u201csales packaging used for transporting products\u201d under Article 29 (reuse targets). It underlines that whether sales packaging can be reused depends primarily on the filling product, and that only sales packaging with an evident transport function is covered by the re-use targets. Several illustrative examples are provided.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-GB\">Confirmation that interlayers and other transport-related packaging not covered by Article 29(1) are excluded from the reuse targets. It is confirmed that interlayers are packaging material and not covered by PPWR.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">Minimisation &amp; empty space:<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">The Guidance recalls the minimisation obligations under Article 10, including the mandate for the Commission to request CEN to update the existing standard by 12 February 2027, to update the methodology for assessment and provide for the maximum adequate weight and volume limits for the most common packaging types and formats.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">Labelling:<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">The objective of the labelling requirements provided for in Article 12(1) is to improve the sorting of packaging waste by consumers.<\/span><\/li>\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\"<i>As Article 12 fully harmonises packaging labelling in the Union, Member States are not allowed to adopt other national mandatory packaging labelling requirements. This is justified by the significant impact on the internal market impact of packaging labelling requirements<\/i>.\u201d<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"x_MsoListParagraph\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li class=\"x_MsoListParagraph\"><b><span lang=\"EN-US\">Conformity Assessment<\/span><\/b>\n<ul type=\"circle\">\n<li class=\"x_MsoListParagraph\"><span lang=\"EN-GB\">A Declaration of Conformity should be issued at the level where packaging shares identical characteristics that are relevant for regulatory compliance. Different sizes of the same packaging may be covered by a single declaration only when the change in size does not influence any of the sustainability requirements.
